在新加坡买房,两个人如何分配持有比例是自由且合法的,decoupling本身也并未被禁止,即便是99/1这样的比例,也可以进行decoupling。

但重点是:税务局关注的不只是形式,还会看你的真实动机和后续行为。合同上写多少比例,就等于你在法律上真正拥有多少产权份额。放弃那1%,就是彻底放弃该房产的产权。

如果表面上是99/1,私底下却有协议说decoupling后仍是共同所有,这种“形式变、实质不变”的安排,不仅不受法律保护,还可能被认定为主要目的是规避额外买方印花税ABSD,一旦被查,可能需要补税并缴罚款。即使手续形式合法,如果意图被认定是避税,也存在违法风险。

总结:99/1也好,decoupling也好,本身并不违法,关键是交易动机要真实、合理、可证明。如果只是为了钻税务的空子,风险极高。所以在操作前,一定要找专业法律和税务顾问,确保全程合规。

But here’s the key: The tax authority looks beyond just the form — they will also examine your real intention and subsequent actions. Whatever proportion is stated in the contract legally reflects the share of ownership you truly have. Giving up that 1% means completely giving up your ownership in the property.

If the arrangement is 99/1 on paper, but you have a private agreement that after decoupling the property will still be jointly owned, this kind of “change in form but not in substance” is not legally protected and may be deemed as primarily intended to avoid Additional Buyer’s Stamp Duty (ABSD). If discovered, you could face back taxes and penalties. Even if the procedures are legally in order, if the intent is judged to be tax avoidance, there is still a risk of it being illegal.

In summary: Whether it’s 99/1 or decoupling, these are not illegal in themselves. The key is that the transaction’s purpose must be genuine, reasonable, and provable. If it is solely to exploit a tax loophole, the risk is very high. Always consult qualified legal and tax professionals before proceeding to ensure full compliance.
